Agreement to These Terms
These Terms & Conditions (“Terms”) govern your use of www.midtownsweeps.com (the “Site”), operated by Midtown Chimney Services® Franchising, LLC (“Midtown,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Our Franchise System
Midtown Chimney Services services are performed by independently owned and operated franchisees licensed to use the Midtown Chimney Services name and trademarks. Each franchisee is solely responsible for the services it performs and for its own obligations and liabilities. Midtown Chimney Services Franchising, LLC operates the Site and central scheduling center and does not itself perform chimney, fireplace, or dryer vent services.
Service Terms
These Terms cover your use of the Site only. Services performed at your property are governed by your estimate, invoice, or service agreement with the franchisee and by our Service Terms & Conditions, including the Midtown Membership Subscription terms where applicable. If these Terms conflict with the Service Terms on any matter relating to services, the Service Terms control.
Quotes, Pricing, and Booking
- Pricing, promotions, and services shown on the Site are general information. They may vary by location, franchise territory, and the size, condition, and accessibility of your chimney or appliance.
- Virtual quotes are estimates based on the information and photos you provide. Final pricing is confirmed by the franchisee and may change after an on-site inspection.
- Submitting an online booking or quote request does not guarantee an appointment. An appointment is confirmed only when our scheduling center or the franchisee confirms it with you.
- Services and availability are not offered in every area.
- We try to keep Site content accurate, but errors in pricing, descriptions, or availability may occur. We reserve the right to correct them at any time.
Informational Content and Safety
Articles, guides, and other content on the Site are general information about chimney, fireplace, stove, and dryer vent care. They are not a substitute for a professional inspection of your specific system. Never rely on Site content alone to decide whether a fireplace, stove, chimney, or vent is safe to use. If you suspect a chimney fire, carbon monoxide exposure, or a gas leak, leave the building and call 911 or your gas utility immediately.
Franchise Information
Information on the Site about franchise opportunities is provided for general informational purposes only. It does not constitute an offer to sell a franchise. A franchise offer can be made only through a Franchise Disclosure Document, and only in states where we are registered, exempt, or otherwise qualified to offer franchises. Any figures or testimonials about franchise performance are not a representation of the results any franchisee will achieve.
Your Submissions
When you submit forms, photos, chat messages, reviews, comments, or other content through the Site, you represent that the information is accurate and that you have the right to share it. You grant Midtown and the applicable franchisee permission to use your submissions to respond to you, quote and perform services, and operate and improve the Site. Reviews and comments may be published on the Site. We may edit or remove any submission at our discretion.
Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Submit false, misleading, or fraudulent information, including fake service requests or reviews.
- Upload content that is defamatory, obscene, infringing, or that contains malware or harmful code.
- Attempt to gain unauthorized access to the Site, the franchise or customer portals, or any related systems.
- Scrape, harvest, or collect data from the Site by automated means without our written permission.
- Interfere with the operation or security of the Site.
Reviews and Testimonials
Customer reviews and testimonials reflect individual experiences and opinions. Results vary depending on the condition of each chimney, appliance, and property, and are not a guarantee of the outcome you will receive.
Intellectual Property
The Site and its content, including text, graphics, logos, photos, videos, and design, are owned by or licensed to Midtown and are protected by copyright and trademark laws. Midtown Chimney Services® and related names and logos are trademarks of Midtown Chimney Services Franchising, LLC. You may view and print Site content for personal, non-commercial use only. The Site may link to or embed third-party websites and services, including franchisee pages, partner fireplace stores, review platforms, social media, and live chat. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MIDTOWN, ITS AFFILIATES, AND THEIR OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Liability for services performed at your property is governed by the Service Terms & Conditions.
Indemnification
You agree to indemnify and hold harmless Midtown, its affiliates, and their owners, officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your use of the Site, your submissions, or your violation of these Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in [CONFIRM: county] County, Colorado, and you consent to the jurisdiction of those courts. Disputes relating to services performed at your property are governed by the choice-of-law and venue provisions of the Service Terms & Conditions.
Changes to These Terms

Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
